In these Terms, we sometimes refer to Fhynix and the Software together as the “Services”.
We’ve tried to make these terms easy to read and understand — avoiding jargon wherever we can. Please read them carefully, because they’re legally binding. When you accept them, we give you the right to use our Services. In return, we’ll need you to follow these Terms.

Before you can start using Fhynix, you will have to sign-in via a third party login provider (like Gmail), where we might be able to get some of the information from the app. Currently, Fhynix is only available via an app. Check the Apple App Store or Google Play Store for details on what operating systems and devices we support.

We’ll do our best to keep you up to date when we’re making changes to our Services. We can change, update, pause, or discontinue any of our product features at any time. We don’t need to give you any notice beforehand, but we’ll try to be reasonable and let you know when we can.
For some features in Fhynix, we’ll automatically pull in information from third party data sources — for example, information on the weather, meal planning, and content sites. While we try to make sure this information is as accurate as possible, it may not always be correct. We might make a mistake, or the data we get from our providers might be wrong or misleading.
For this reason, it’s always important to double-check the information against trusted sources. We aren’t responsible for any inconvenience, loss, damage, or personal injury that comes about because you’ve used or relied on inaccurate information that we’ve provided you, unless it was caused by our negligence.
In addition, with some of the features we offer, timeliness is important — examples include event notifications and reminders. We won’t be responsible for inconvenience, loss, damage, or personal injury that you suffer because these features haven’t worked as expected, unless it was caused by our negligence.
It’s important to us that you’re in control of your personal information, and the things that you add to your Fhynix account (like your calendar entries). Fhynix lets third party apps (individuals and other companies) access your data through our Application Programming Interface (API). The API also lets them add things to your account on your behalf.
How access works:
It’s important to review the terms of service and privacy policy of any app you connect to Fhynix. We’re not responsible for the way third party apps use your information, or anything that this app might add to your Fhynix account.
When we say “Intellectual Property Rights”, we mean any patents, copyrights, moral rights, trademarks, business names, domain names, designs, software rights, or confidential information that we hold — as well as any other intellectual property rights (registered or not registered) that we hold now, or will hold in the future.
We and our licensors own all of the Intellectual Property Rights to our Services, and these Terms don’t give you any of these rights.
In the future, we might transfer the rights and obligations we have under these Terms to another company, as long as it doesn’t materially affect your rights. You can’t transfer your rights or obligations under these Terms to anybody else — because these Terms are personal to you, and nobody else is entitled to benefit from them.
As we grow and improve Fhynix, from time to time, we might need to make changes to these Terms. We’ll do this by uploading a new version of the Terms to our website, with a date to show when we uploaded them.
Sometimes, when we release a new product feature or service, we might decide to introduce new terms relating to that feature — we might provide them separately to these Terms. If we do, you’ll need to agree to those terms before you can use the feature.
If you carry on using our Services after we make changes to the Terms, it means you’ve agreed to them. The new version of the Terms replaces the old version — so the new Terms apply going forward.
Fhynix is currently a free service. In the future, we might offer new features or additional premium services that you’ll need to pay for. If we do, we will either update these Terms, or create separate terms to cover the paid services we’re offering — and you’ll need to agree to those terms before you can access them.
If we decide to start charging for Services that were previously free, we will:
If this happens, you can either pay to use the premium services or stay on the free account. If you choose not to pay, you may lose access to all or parts of your account.
If you don’t follow the Terms we’ve set out, we can remove your access to Fhynix straight away — meaning you’ll no longer be able to access your account, and you won’t be allowed to open a new account in the future.
We can also remove your access to all or parts of Fhynix without giving you a reason, with at least 90 days’ notice. From time to time, we might need or choose to impose limits on our Services — if we do, we’ll try to give you 90 days’ notice.
While we hope you’ll love using Fhynix, we can’t guarantee that it’ll meet your needs. We also don’t guarantee that the service will always be available, or be free from errors. From time to time, it’s possible that your access to the service will be interrupted — if this happens, we won’t be responsible for any loss or damage that comes about as a result.
We take steps to preserve your data and protect its integrity, including replicating data to protect against hardware failure and taking regular backups where possible. We won’t be responsible for loss of your data, or any corruption to it.
If we don’t follow these Terms, we won’t be responsible for any loss or damage that isn’t foreseeable. When we say “foreseeable”, we mean that:
At the moment, our Services are provided for personal use only. This means that, even if we don’t follow these Terms, we’re not responsible for any business interruption, or loss of business earnings or opportunities.
To be clear, we don’t limit our responsibilities to you where it wouldn’t be lawful. For example, we don’t limit our responsibility when we’ve breached your consumer rights, or when we’ve caused death or personal injury due to our negligence.

To keep Fhynix safe and running smoothly, we keep an eye on how people are using our Services and take action when we need to. You agree that we can monitor your use of Fhynix to make sure you’re not breaking our Terms. We’ll always do this in line with our privacy policy.
